Chapter 1. General Provisions

Article 1 (Purpose)

These Terms of Use are intended to stipulate the conditions and procedures for using all services (hereinafter referred to as the "Services") provided by Nano Fine Tech Co., Ltd. (hereinafter referred to as the "Company") through its website, nanofine.co.kr.

Article 2 (Definitions)

The definitions of terms used in these Terms of Use are as follows:

1. "User" means a person who receives the Services provided by the Company in accordance with these Terms of Use.

2. "Service Agreement" means an agreement entered into between the Company and a User regarding the use of the Services.

3. "Registration" means the act of completing a Service Agreement by entering the required information in the application form provided by the Company and agreeing to these Terms of Use.

4. "Member" means a person who has registered as a member by providing the personal information required for membership registration on this website.

5. "User ID" means a combination of letters and numbers selected by the User and approved by the Company for identification and use of the Services.

6. "Password" means a combination of letters, numbers and special characters established by the Member for the protection of the Member's information.

7. "Termination" means an expression of intent by the Company or a Member to terminate the Service Agreement after commencement of the Services.

Article 3 (Effectiveness and Amendment of the Terms)

If a Member does not agree to amended Terms of Use, the Member may request withdrawal or termination of membership. If the Member continues to use the Services without expressing an objection within seven (7) days from the effective date of the amended Terms of Use, the Member shall be deemed to have agreed to the amendment.

① These Terms of Use shall become effective when posted on the Service screen, announced on the notice board, or otherwise notified to Users.

② The Company may amend these Terms of Use when deemed necessary. The amended Terms of Use shall be announced on the Service screen. If a Member continues to use the Services without expressing an objection for seven (7) days after such announcement, the Member shall be deemed to have agreed to the amended Terms of Use.

③ If a User does not agree to the amended Terms of Use, the User may discontinue use of the Services and cancel his or her membership registration. Continued use of the Services shall be deemed acceptance of the amended Terms, which shall become effective in the same manner as set forth above.

Article 4 (Applicable Laws and Regulations)

Matters not specified in these Terms of Use shall be governed by the Telecommunications Basic Act, the Telecommunications Business Act, and other applicable laws and regulations.

Chapter 2. Service Use Agreement

Article 5 (Formation of the Service Agreement)

The Service Agreement shall be formed upon the Company's acceptance of a User's application for use of the Services and the User's agreement to these Terms of Use.

Article 6 (Application for Use)

A User may apply for use of the Services by entering the personal information required by the Company in the membership application form provided on the Service membership information screen.

Article 7 (Acceptance of Application)

① The Company shall, in principle, accept an application for use of the Services when a Member has accurately completed all required information in the application form, unless there are special circumstances.

② The Company may refuse to accept an application in any of the following cases:

1. If the application is not made under the applicant's real name.

2. If the application is made using another person's name.

3. If false information is provided in the application.

4. If the application is made for the purpose of disrupting public order or accepted social standards.

5. If the applicant fails to satisfy other requirements for application established by the Company.

Article 8 (Changes to Registration Information)

A Member shall update any information provided at the time of application if such information changes. The Member shall be responsible for any problems arising from failure to update such information.

Chapter 3. Obligations of the Contracting Parties

Article 9 (Obligations of the Company)

The Company shall not disclose or distribute personal information of Members obtained in connection with the provision of the Services to any third party without the Member's consent.

However, this shall not apply where disclosure is requested by a government authority pursuant to applicable laws, including the Telecommunications Basic Act, where required for criminal investigations, or where requested in accordance with procedures prescribed by applicable laws and regulations.

Article 10 (Obligations of Members)

① Members shall not engage in any of the following activities when using the Services:

1. Unauthorized use of another Member's User ID.

2. Reproduction, publication, or provision to a third party of information obtained through the Services.

3. Infringement of copyrights of the Company or third parties, or other rights.

4. Distribution of content that violates public order or accepted social standards.

5. Conduct that may objectively be considered related to criminal activity.

6. Any other conduct that violates applicable laws and regulations.

② Members may not use the Services for commercial activities, and the Company shall not be liable for any consequences arising from commercial activities conducted through the Services.

③ Members may not transfer or assign their right to use the Services or any other contractual status to another person, nor may such rights be provided as collateral.

Chapter 4. Use of Services

Article 11 (Obligations of Members)

① Members are responsible for maintaining and managing their own e-mail, bulletin board posts, registered data and other information as necessary.

② Members may not arbitrarily delete or modify materials provided by the Company.

③ Members shall not post content on the Company's website that violates public order or accepted social standards, or that infringes the copyrights or other rights of third parties. The Member shall bear full responsibility for all consequences arising from posting such content.

Article 12 (Management and Deletion of Posts)

For efficient operation of the Services, the Company may limit storage capacity, message size, retention periods and similar matters. The Company may delete posted content without prior notice if it falls under any of the following:

1. Content that defames or damages the reputation of another Member or a third party.

2. Content that violates public order or accepted social standards.

3. Content deemed to be associated with criminal activities.

4. Content that infringes copyrights of the Company or third parties, or other rights.

5. Pornographic content posted by a Member on the Company's website or bulletin boards, or links to pornographic websites.

6. Other content deemed to violate applicable laws and regulations.

Article 13 (Copyright of Posts)

Copyright in posts belongs to the respective author. Members may not use materials posted through the Services for commercial purposes, including processing or selling information obtained through the Services.

Article 14 (Service Hours)

In principle, the Services shall be available twenty-four (24) hours a day, seven (7) days a week throughout the year, unless there are operational or technical difficulties. This shall not apply during scheduled maintenance or other necessary interruptions.

Article 15 (Responsibility for Use of Services)

Users shall not use the Services to engage in hacking, provide links to pornographic websites, illegally distribute commercial software, or engage in similar activities. The Company shall not be liable for any business consequences, losses, or legal actions by relevant authorities arising from violations of this provision.

Article 16 (Suspension of Services)

The Company may suspend provision of the Services in any of the following circumstances:

1. When unavoidable due to maintenance, repair or construction of Service-related facilities.

2. When a telecommunications carrier regulated under the Telecommunications Business Act suspends telecommunications services.

3. When system inspection is necessary.

4. When other force majeure circumstances occur.

Chapter 5. Termination and Restriction of Use

Article 17 (Termination and Restriction of Use)

① If a Member wishes to terminate the Service Agreement, the Member must apply for termination through the Internet. The Company shall take the necessary action after verifying the Member's identity.

② If a Member engages in any of the following activities, the Company shall notify the Member of its intention to terminate the Service Agreement no later than thirty (30) days prior to termination and provide the Member with an opportunity to state his or her opinion:

1. Unauthorized use of another person's User ID or password.

2. Intentional interference with the operation of the Services.

3. Submission of a false membership application.

4. Duplicate registration by the same User using different IDs.

5. Distribution of content that violates public order or accepted social standards.

6. Conduct that damages another person's reputation or causes disadvantage to another person.

7. Transmission of excessive amounts of information or advertising information for the purpose of interfering with the stable operation of the Services.

8. Distribution of computer viruses or similar programs that cause malfunction of information and communications facilities or destruction of information.

9. Infringement of intellectual property rights of the Company, another Member, or a third party.

10. Unauthorized use of another person's personal information, User ID, or password.

11. Posting pornographic content or links to pornographic websites on a Member's homepage, bulletin board, or similar area.

12. Other conduct deemed to violate applicable laws and regulations.

Chapter 6. Miscellaneous Provisions

Article 18 (Prohibition of Assignment)

Members may not transfer or assign their right to use the Services or any other contractual status to another person, nor may such rights or status be provided as collateral.

Article 19 (Compensation for Damages)

The Company shall not be liable for any damages incurred by a Member in connection with Services provided free of charge, except where such damages result from the Company's intentional misconduct or gross negligence.

Article 20 (Disclaimer)

① The Company shall be exempt from liability for failure to provide the Services due to natural disasters, war, or other force majeure events of a similar nature.

② The Company shall be exempt from liability for damages arising from unavoidable circumstances such as maintenance, replacement, periodic inspection or construction of Service-related facilities.

③ The Company shall not be liable for interruption or disruption of the Services caused by reasons attributable to a Member.

④ The Company shall not be liable for profits expected by a Member from use of the Services or for damages arising from materials obtained through the Services.

⑤ The Company shall not be responsible for the reliability, accuracy or content of information, materials or facts posted by Members through the Services.

Article 21 (Jurisdiction)

If a lawsuit is filed in connection with a dispute arising from use of the Services, the court having jurisdiction over the location of the Company's principal office shall have exclusive jurisdiction.

Supplementary Provision

Effective Date: These Terms of Use shall take effect on August 15, 2024.
